Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MaxAI (the “Service”), provided by MaxAI, Inc. (“MaxAI”, “we”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.

These Terms are a working draft prepared in advance of MaxAI's general launch. They will be replaced with reviewed legal language. If you are a paying customer and need the final form before that update lands, contact andy@sknk.us.

1. Accounts

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for activity under your account. Notify us immediately of any unauthorized use.

2. Acceptable Use

You agree not to:

• Use the Service to violate any law or third-party right.
• Reverse engineer, decompile, or attempt to extract our source code.
• Interfere with the Service's integrity, security, or performance.
• Submit false credentials for the third-party systems MaxAI integrates with (NetSapiens, Bandwidth, Commio, Stripe, etc.).
• Use the Service to send unsolicited communications or harass others.

3. Your Data & Third-Party Systems

MaxAI integrates with NetSapiens and other carriers/services using credentials you provide. You authorize MaxAI to act on your behalf with those services strictly to perform the operations you initiate through the Service. You retain ownership of your data and the data you manage through those integrations. MaxAI does not sell your data.

4. Subscriptions & Billing

Paid plans are billed monthly or annually in advance via Stripe. Token allowances reset each billing cycle and do not roll over. Annual plans renew automatically; you may cancel at any time and your subscription will remain active through the end of the current term.

One-time credit packs are non-refundable once applied. Subscription fees may be refunded at our discretion within 7 days of charge if you have not made material use of the Service.

5. Service Availability

We aim for high availability but provide the Service “as is” without uptime guarantees on the Starter and Pro tiers. Enterprise agreements may include an SLA.

6. Intellectual Property

MaxAI retains all rights to the Service, including software, designs, and trademarks. You receive a non-exclusive, non-transferable license to use the Service while your subscription is active.

7. Termination

Either party may terminate this agreement at any time. Upon termination we will, on request, export your data in a reasonable format and delete it within 30 days unless retention is required by law.

8. Disclaimer & Limitation of Liability

The Service is provided without warranties of any kind, express or implied. To the maximum extent permitted by law, MaxAI's total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes

We may update these Terms from time to time. Material changes will be announced via email and on this page. Continued use of the Service after changes take effect constitutes acceptance.
